Terms and Conditions

§ 1 Contractual basis

The following terms and conditions apply to all contracts you conclude online with Gartenzauber Katja Hildebrandt. By placing your order, you acknowledge the following terms and conditions.

§ 2 Offer and conclusion of contract

2.1

Unless otherwise stated in the item description, the goods offered by Gartenzauber Katja Hildebrandt on the Internet are available and can be purchased via the website shop.gartenzauber.com and, where applicable, via associated sales systems.

We reserve the right to supply end users only in commercially available quantities.

2.2

Orders placed via the Internet are binding offers.

2.2.1 Ordering process

By clicking the "Buy" button, you place a binding order for the items in your shopping cart. Confirmation of receipt of the order will be sent by email immediately after submission and does not constitute acceptance of the contract. Acceptance of the order occurs either by sending an order confirmation by email or by shipping the goods.

§ 3 Cancellation policy

3.1 Right of withdrawal

You have the right to cancel the contract within 14 days without giving any reason. This period begins upon receipt of the goods. You can cancel by letter, email, or fax to the following address:

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period has expired.

3.2 Consequences of revocation

In the event of a cancellation, we will refund all payments (including standard shipping costs) within 14 days of receipt of the returned item. You are responsible for the return shipping costs. Returns from abroad are always the responsibility of the customer.

3.3 Exclusion of the right of withdrawal

The right of withdrawal does not apply to:

Goods manufactured according to customer specifications.
Perishable goods such as seeds, dahlia tubers, ranunculus and anemones, as they are subject to natural aging processes and their germination or planting quality may be affected by improper storage or delays in shipping.
Sealed goods (e.g. hygiene products) if the seal has been removed after delivery.
Goods if they have been inseparably mixed with other goods after delivery.

§ 4 Prices and shipping conditions

4.1 Prices

The prices displayed on the website at the time of ordering apply. All prices are in euros (EUR) and include VAT.

4.2 Shipping costs

Germany: 5.90 EUR
Belgium, Denmark, France, Italy, Netherlands, Austria, Poland, Portugal, Sweden, Spain: 17.90 EUR
Returns are to be borne by the customer.
Unfortunately, shipping to Switzerland is not possible.

4.3 Shipping partner & delivery

We determine the logistics partner and deliver within the EU.

4.4 Partial deliveries

Partial deliveries and partial services are permissible. Each partial delivery and partial service deemed acceptable to the buyer is considered an independent delivery and service. Where possible, the customer will receive their order in one shipment.

4.5 Force majeure & unforeseen delivery obstacles

Unforeseen delivery obstacles that are beyond the control of Gartenzauber Katja Hildebrandt entitle Gartenzauber Katja Hildebrandt to extend the delivery or any agreed delivery period appropriately.

4.6 Legal & regulatory delivery delays

We are not responsible for delivery delays caused by legal or official regulations (e.g., import and export restrictions). In important cases, we will notify the customer of the start and end of such impediments as soon as possible.

§ 5 Returns & Returns

5.1 Returns within Germany

You can return items within 14 days of receipt if you don't like them, the size isn't right, or they arrived damaged. This does not apply to items made to customer specifications, perishable goods, and sealed items.

You are responsible for the return shipping costs.

You are responsible for organizing your return yourself. We recommend using a trackable shipping method to ensure your return reaches us. Once we receive your return, we will contact you regarding further processing.

5.2 Returns from abroad

All returns from abroad (including Austria, Belgium, Denmark, France, Italy, the Netherlands, Poland, Portugal, Sweden and Spain) must be paid for by you.

The German right of withdrawal also applies to customers from these countries. This means that you can return your order at your own expense and within the specified deadlines (see cancellation policy).

§ 6 Guarantee and warranty

The legal provisions apply.

6.1 Warranty for living plants (tubers/bulbs)

We guarantee the impeccable quality of the tubers upon shipment.
You must report any defects within 5 days of receipt.
An exchange or return is only possible within this period.
Successful breeding is your responsibility.

§ 7 Liability

We are fully liable for damages resulting from intentional or grossly negligent breaches of duty. We are only liable for simple negligence in the event of a breach of essential contractual obligations.

§ 8 Force majeure

Delays in delivery due to force majeure (e.g. natural disasters) entitle us to delay delivery or to withdraw from the contract.

§ 9 Miscellaneous

We comply with all applicable data protection laws. See our privacy policy.

Alternative dispute resolution according to Art. 14 para. 1 ODR-VO and Section 36 VSBG:

The European Commission provides a platform for online dispute resolution (ODR), which you can find at http://ec.europa.eu/consumers/odr/ . We are willing to participate in an out-of-court dispute resolution procedure.

§ 10 Discount Code Conditions

Not valid for discounted items.
Shipping costs are not included in the purchase value.
For returns that fall below the minimum purchase value, the discount will not apply.
No retroactive application to existing orders.

§ 11 Storage of the contract text

Your order and the Terms and Conditions will be saved. You will receive all relevant information via email. If you have a customer account, you can view your orders there.

These Terms and Conditions come into effect immediately.
